Florida’s relocation statute is very clear regarding the requirements for parents who want to move with children. Absent getting an agreement from your spouse, in writing, the Florida courts can be very harsh in addressing the relocation of parents who move without obtaining Court permission. Florida Statute Section 61.001 addresses parental relocation with a child. A discussion about this statute, together with the consequences of moving without following this statute, should be discussed at length with an attorney prior to making plans to move.

In addition, once a divorce action is filed in Collier County, the Court will issue a Standing Temporary Order with Children. This Order will prevent you from leaving with children without either the written consent of your spouse or a court Order. This can have the effect of limiting out-of-state travel while you are getting divorced.
