Premarital and Postnuptual Agreements
Prenuptial Agreements are a way for a couple to determine their rights and liabilities to one another before their marriage. In Florida, the recently enacted Uniform Premarital Agreement Act, Section 61.079, provides the basis for crafting an agreement before marriage. In most cases, the purpose of crafting a Premarital Agreement is to preserve existing assets prior to the marriage or to secure these assets for children born prior to the marriage. Postnuptial Agreements are entered into after a marriage for the purpose of securing assets and liabilities between the parties without a divorce.
