Modification of Agreements
Oftentimes, parties want to modify the terms of the agreements, and Court Orders, made in their divorce. Agreements to settle property rights are generally not modifiable while provisions concerning children’s issues and spousal support are generally modifiable. In order to modify agreements concerning parenting issues and support, you will need to prove that there has been a substantial change since your divorce which would cause the Court to change the original provisions. These issues are very fact specific and whether you have sufficient facts to proceed is determined on a case-by-case basis.
